This Privacy Notice explains what information we collect, how we use it, with whom we share it, and how we protect it.
This Privacy Notice covers personal information collected through the Platform, including information exchanged through its scheduling, payment, and messaging tools. If you use those tools in connection with a professional-services engagement, such as tax preparation, payroll, bookkeeping, or advisory work, the applicable engagement letter and any client privacy notices or consents we provide also apply.
This Privacy Notice does not replace any consent required for the use or disclosure of tax return information. Use of the Platform is governed by our Terms of Use, available at https://www.smashingnumbers.com/terms-of-use.
1. Information We Collect
We collect the personal information you choose to give us through the forms and tools on this website. That is ordinarily your name, your company name and business type, your email address, and your telephone number, together with any annual revenue figure you enter into one of our assessment tools.
We also collect the content of messages you send us through the Platform, your responses to assessment and calculator questions, and the appointment details you provide when scheduling with us. If you opt in to text messages, we also keep your mobile number, a record of your consent, your message preferences, and the history of messages between us.
If you pay us through the Platform, payment card or bank account details are collected and processed by our payment processor, and we do not store full payment card numbers on our own systems. Please do not submit tax documents, Social Security numbers, or similar sensitive items through the website's general forms or by text; clients are provided a secure upload link through our client portal, and information submitted there is governed by the applicable engagement letter and related consents.
We also collect certain information automatically when you use the website, as described in Section 10 (Cookies and Tracking Technologies).
2. How We Collect Information

We collect this information through our Financial Assessment form, the Profit First Calculator, our Contact Us form, and any mobile opt-in form we make available. We may also collect information through other forms identified when the information is requested.
3. How We Use Your Information
We use what we collect to answer your questions and send the information you asked for about our services; to send email about our work, including newsletters, tax-strategy notes, webinar and event invitations, notice of new articles, and growth-advisory content, where you have consented or the law otherwise permits; to send text messages, but only of the type you specifically consented to receive; to maintain our client and prospect records; to improve this website and its content; and to meet our obligations under applicable law.
4. Email Communications: Consent, Content, and Opt-Out
When you submit your email address through a form on this Platform, we may use it to respond to your inquiry and, where you provide the applicable consent or where otherwise permitted by law, send marketing communications.
Our email may include a periodic newsletter on financial management, tax-planning and regulatory updates, invitations to webinars and events, notice of new articles and other educational material, growth and coaching updates, and promotional messages about our services and programs. We do not send marketing email on a fixed schedule, and frequency varies.
You may withdraw consent and opt out of marketing email at any time by clicking the unsubscribe link in an email or by emailing privacy@smashingnumbers.com with “Unsubscribe” in the subject line. Transactional, service-related, or legally required communications may still be sent when permitted by law.
5. SMS/Text-Message Communications: Consent, Content, and Opt-Out
If you separately opt in to receive SMS/text messages from Smashing Numbers LLC, you agree to receive the message types identified in the applicable opt-in disclosure, such as conversational and service-related messages.
In practice, we text current clients to request information we need to complete an engagement, to send one-time codes, and to confirm or follow up on appointments.
If you separately opt in to receive marketing or promotional text messages from Smashing Numbers LLC, we may send messages concerning our services, programs, events, offers, educational content, and related promotions.
Consent to marketing texts is separate from consent to conversational or service-related texts and is not a condition of purchasing any product or service. We will send marketing texts only to recipients who provide the separate consent presented for that campaign or use case.
The message types stated in the disclosure must match the campaign or use case for which consent is obtained. No mobile opt-in or text-message consent will be shared with third parties or affiliates for their own marketing purposes. Reply STOP to any message to opt out, or HELP for support. Message and data rates may apply, and message frequency varies.

We will maintain suppression records and will not send further texts to that number after a valid opt-out, other than a single message confirming the opt-out, unless you later provide new consent.
6. Data Storage and Processing Platforms
Your information may be stored, routed, or processed by the third-party providers we use to operate this website, including Jotform for form capture and routing, Qount for client relationship management, Google Sheets and Google Forms for aggregation and tracking, and GoHighLevel for our marketing pipeline and communications. Some information also reaches us by email in our internal team inbox. We update this list as our providers change.
The website is hosted on Webflow. Website analytics are provided through Google Tag Manager, Google Analytics, and Microsoft Clarity. Cookie preferences and consent records are managed through Cookiebot.
Email communications are sent through Flodesk, GoHighLevel, and Customer.io. Text messages are sent through SimpleTexting and GoHighLevel.
Payments are processed through QuickBooks Payments and Stripe. Client bookings are scheduled through Calendly. Certain internal workflows are automated through n8n.
7. Third-Party Data Sharing
We do not sell, rent, trade, or share your personal information with external data brokers, advertisers, or unaffiliated third parties for their own marketing purposes.
We may disclose information to service providers that process it on our behalf, to our affiliates and subsidiaries under common ownership or control for the purposes described in this Notice, to personnel and contractors who need it to operate the Platform or provide services, when required by law, or as part of a business transfer.
SMS opt-in and consent records will not be shared with third parties or affiliates for their own marketing purposes.
Your information may be accessible to our operations personnel; to contracted administrators of our IT, hosting, web-design, client-relationship, form, analytics, email, and messaging systems, in each case for the purpose of operating those systems or delivering services; and to the providers named in Section 6.
We require service providers handling personal information to maintain reasonable security measures appropriate to the nature of the information and applicable law.
8. Data Retention
We retain personal information for as long as reasonably necessary to maintain our relationship with you, provide requested information and services, comply with legal, accounting, or regulatory obligations, resolve disputes, enforce agreements, and maintain required consent or suppression records. If you request deletion and we are not legally required to retain the information, we will honor the request within a reasonable timeframe.
9. Your Privacy Rights
Depending on your state of residence and applicable law, you may have the right to request access to, correction of, or deletion of personal information; withdraw consent to email or SMS marketing; and exercise other rights provided by applicable privacy law. 10. Cookies and Tracking Technologies
Our website uses cookies, web beacons, pixels, analytics tools, and similar technologies, including Google Tag Manager, Google Analytics, and Microsoft Clarity, to collect usage data such as your IP address, cookie and device identifiers, approximate location inferred from your IP address, pages visited, time on site, device or browser type, referral information, and recordings of page interactions such as clicks, scrolling, and mouse movement collected through our session-analytics tool, which is configured to mask what you type into form fields. This data helps us understand how visitors use the Platform and improve our content. You can accept or decline categories of nonessential cookies through the Cookiebot preference tool on our website and change your choices there at any time, and nonessential cookies are set only in accordance with your selections. You may also configure your browser to refuse cookies, although doing so may limit certain Platform functionality.
11. Data Security
We implement reasonable administrative, technical, and physical safeguards designed to protect collected information against unauthorized access, disclosure, alteration, and destruction. No method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.
12. Children’s Privacy
The Platform and our services are intended for adults and business professionals. We do not knowingly collect personal information from individuals under 18.
